Effective January 1, 2011 OTC medicines and drugs (except insulin) are no longer eligible for reimbursement under FSA unless prescribed by a medical doctor! The newly enacted law states:
… reimbursement for expenses incurred for a medicine or a drug shall be
treated as a reimbursement for medical expenses only if such medicine or
drug is a prescribed drug (determined without regard to whether such drug
is available without a prescription) or is insulin. – H.R. 3590
Also, debit cards will be denied when purchasing these items as participants will need to submit a claim form for reimbursement along with a copy of the prescription.
